This website is operated by Ancarta Pty Ltd (“Ancarta”, “we”, “us” or “our”). These Terms of Service apply when you use our website, place an order or use our services.

By doing so, you agree to these Terms and to our Privacy Policy, Shipping Policy and Returns & Exchanges Policy. If you accept an Ancarta invitation, our Invitation & Community Terms also apply.

Nothing in these Terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or other consumer protection laws that apply to you. Our online store is hosted by Shopify.

1. Using our website

By using our website, you confirm that you are at least the age of majority where you live, or that you have permission from a parent or guardian. You agree to:

Give accurate, current and complete information
Use our website only for lawful purposes
Not interfere with the security or operation of our website, or attempt to access our systems or other customers’ accounts
Not upload viruses or harmful code, or scrape or extract website data without permission
Not impersonate another person or misuse our promotions or codes

We may suspend or restrict access where we reasonably believe these Terms have been breached.

2. Products

We aim to show our products, colours, sizing and descriptions as accurately as possible, but colours can look different depending on your screen and lighting. All products are subject to availability, and we may change or discontinue products at any time.

3. Prices and payment

Prices are shown in the currency displayed at checkout. Prices may change at any time, but changes won’t affect an order we’ve already accepted. Payments are processed by secure payment providers. Import duties and taxes for international orders are explained in our Shipping Policy.

4. Orders

An order is accepted when we confirm or dispatch it. We may refuse or cancel an order where reasonably necessary, including where:

Payment can’t be authorised
A product or price was shown in error
Stock is unavailable
We suspect fraud, misuse of a promotion or unauthorised resale
The order breaches these Terms

If we cancel an order after payment has been taken, we’ll refund the amount paid to your original payment method.

5. Discount codes and promotions

Discount codes, offers and promotions have their own conditions and may change or end. Offers that come with an invitation, personal 15% codes and community rewards are governed by our Invitation & Community Terms, including the notice we give before reducing those benefits. Unless an offer says otherwise:

Only one discount code can be used per order
Codes can’t be applied to past orders
Free items and rewards have no cash value
Free items can be returned or exchanged only as set out in our Returns & Exchanges Policy

We may refuse or remove a promotion, code or reward where we reasonably believe it has been misused.

6. Invitations, community and collaborations

Taking part in an Ancarta invitation, community or collaboration offer is optional. It doesn’t create an employment, agency or partnership relationship, and you can’t act or speak on our behalf, unless we agree otherwise in writing. Personal codes must not be used in a fraudulent or misleading way.

7. Shipping and returns

Delivery is covered by our Shipping Policy. Returns, exchanges, cancellations and refunds are covered by our Returns & Exchanges Policy, which also explains the right to cancel for customers in the EU and UK.

8. Intellectual property

All content on this website, including our logos, branding, product names and designs, photography, imagery, videos and written content, is owned by or licensed to Ancarta. You may not copy, reproduce, publish or use it without our written permission.

9. Your content and reviews

If you share content with us, tag us, or leave a review or feedback, you confirm that you have the right to share it and that any review reflects your genuine experience. You give us a non-exclusive, worldwide, royalty-free licence to use, display and share that content on our website, social media, emails and advertising, unless you tell us otherwise in writing.

Content must not be unlawful, misleading, abusive or infringe anyone’s rights. We may moderate or remove content that breaches these Terms.

10. Third-party services

Our website may link to or use third-party services, such as payment providers, carriers and social media platforms. We’re not responsible for their content or practices, and their own terms and privacy policies may apply.

11. Errors

Our website may occasionally contain errors in descriptions, prices, promotions, shipping charges, delivery estimates or availability. We may correct errors at any time. If an error affects an order you’ve placed, we’ll deal with it fairly and in line with consumer law.

12. Our liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes or limits liability that can’t lawfully be excluded.

To the extent the law allows, we are not liable for indirect or consequential loss, and we don’t guarantee that our website will always be uninterrupted or error-free. Where the law allows us to limit our liability for goods, it is limited to replacing or repairing the goods, supplying equivalent goods, or paying the cost of replacement, repair or a refund.

13. Indemnity

To the extent permitted by law, you agree to cover reasonable losses we incur as a direct result of your unlawful use of our website, your material breach of these Terms, or your infringement of someone else’s rights.

14. Privacy

How we handle your personal information is explained in our Privacy Policy.

15. General

If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply. These Terms, together with the policies they refer to, are the full agreement for your use of our website and services.

16. Changes to these Terms

We may update these Terms from time to time. The current version is always published on this page with its date. Changes don’t affect orders already placed.
